Yayın Migration and national identity: an international law perspective(Maltepe Üniversitesi, 2016) Nugroho, Fitri RamadantiThrough time, large scaled migration has affected the level of diversity around the globe, which transforms communities and has challenged the notion of national identity of states. lnternational law has contributed normative and legal tramework regarding the powers and responsibility of states to management movements across borders, the rights and responsibilities of migrants and the cooperation between states in managing the movement of people, yet gaps under international law and norms still persist. As states feel their social community states fraying because of migrants, states enact their soyereign power by creating strict regulations about the rights of residency and citizenship. The openness of state can plays a big role to avoid citizens of the host country to be indifferent, apathetic, discriminative or undermining as these reactions can affect the way migrants react in the host country. National identity today should evolve to accommodate the movement of people in order to preserve the moral order and unity of society by embracing the idea of multiculturalism which means that ethnicity will no longer be the defining characteristics of it means to be a part of a state. This paper provides insights on the effectiveness of the current laws and norms under international law on the protection of migrants by filling gaps with the notion of accepting multiculturalism based on a more inclusive idea of national identity in order to make a broader society.
