Sosyal devlet ve insan hakları

Abstract

Bu çalışmanın amacı, insan haklarının bir kısmını oluşturan sağlık hakkı, eğitim hakkı, çalışma hakkı gibi temel kişi haklarının -literatürdeki yaygın adları ile sosyal haklarıngetirdiği taleplerin yerine getirilmesinde sosyal devletin rolünü ve önemini ortaya koymaktır. Sosyal devlet ilkesi bağlamında hayata geçirilen sosyal haklar, sosyal adalet, sosyal güvenlik ve sosyal harcamalarla ilişkisi yönüyle de incelenecektir. Öte yandan sosyal devletin zayıflatılarak, sosyal hakların yaşama geçirilebilmesinin önünde önemli bir engel olarak görülen küreselleşme olgusu incelenecektir. Ayrıca, Türkiye’de sosyal devlet ilkesinin gelişimi ve sosyal hakların korunmasında günümüzde gelinen durum, 1924’ten beri yapılan anayasalarda yansıdığı şekliyle karşılaştırmalı olarak ele alınacaktır.

The purpose of this study is to show the role and the importance of social state in carrying out of the demands of basic rights, such as the right to health, the right to education and the right to work, which in literature are usually called social rights and which constitute a significant part of human rights. Social rights which are implemented in the context of the social state principle, will be examined in connection with social justice, social security and social spending. On the other hand, globalization, which by weakening the social state, constitutes a significant obstacle to the realisation of rights, will be examined. The development of the social state in Turkey and the current situation in the protection of social rights will be also discussed by comparing their place in the constitutions enforced since the year 1924.
