Intellectual property as a means of encouraging innovations in Kazakhstan

Kazakhstan has human capital with sufficient innovative potential. Nevertheless, the country experiences the process of brain drain, in part because the current Kazakhstani legislation does not protect ideas. According to the Law on Copyright and Neighboring Rights of the Republic of Kazakhstan, ideas, concepts, principles, methods, processes and discoveries are not a subject of copyright. Thus, accounting for the crucial role innovations play in the economy of the country. this paper argues that the government should recognize idea as an intellectual property and propose a more efficient way of copyright protection in order to stimulate innovation in the country. The first part of the paper reviews, critically analyzes and demonstrates the sources of inefficiencies of the Copyright Law and Neighboring Rights for the economy of the Republic of Kazakhstan. Since no scholarly work has examined the field of intellectual property in Kazakhstan, this paper relies on the official consolidated texts of the Kazakhstani legislation.
