Yayın Conundrum of balancing legitimate concern of state and individuals: special reference to India(Maltepe Üniversitesi, 2016) Mathew, MeeraThe state has come into existence primarily to assure its citizens minimum of social security and further to involve them in social and political processes in a fully self-determining manner. The relevance of slate responsibility stems from there that assures that state should act to avert any sort of disturbances to its sovereignty and create a sheltered and protected atmosphere to its citizens. Hence, statelessness is that the condition of not being a national of any state and it happens when the state is at threat and there is absence of sovereignty. This paper attempts to trace the jurisprudential aspect of the formation of a state its sovereign functions, the issues and chaIlenges of statelessness, its consequence on national and international arena with relevant examples. Further it would also analyses the lndian situation and critically examine its functioning, accordingly would come up with suflicient suggestions. The researcher believes that a state has an inherent responsibility to guard one's own citizens. Hence, any sort of aggression and uncertainty would question the government's capability to virtually execute this main function i.e. the safeguard of constitutional freedoms including the right to life and the right to security. The researcher thus opines that if the government is ineffective to ensure all the rights of its citizens, it should be looked on to properly: otherwise the existence of a state would be questioned.
