Yayın The position of human rights in international investment arbitration(Maltepe Üniversitesi, 2015) Rengers, Emma; Gençal, Talhalnternational investment law and international human rights law are currently looked upon as two completely separate fields of law. Some scholars even argure that international investment law and arbitration undermine international human rights law. The fields of law do share, however, a common concern (i.e. the protection of an individualagainst the State) and there might exist a greater interdependence between the two fields of law than is often thought. This paper explores the position of human rights in international investment arbitration.
