Özet
Yabancı yatırımların teşviki amacıyla devletler farklı uygulamalar geliştirmektedir. Özellikle nitelikli yabancı işçilerin çalıştırılması amacıyla kolaylıklar getirilmektedir. Türkiye, yabancıların çalışma izinleri konusunda son yıllarda önemli yenilikler içeren düzenlemeler yapmıştır. Özellikle 6735 sayılı Uluslararası İşgücü Kanunu ile ülkemiz ekonomisine ve istihdama olumlu katkıda bulunacak nitelikli yabancılara, Turkuaz Kart adı altında yeni bir çalışma izin sistemi getirilmiştir. Bu çalışmada Turkuaz Kart ve bu kartın nasıl ve kimler tarafından alınabilineceği, Turkuaz Kart sahibinin hak ve yükümlülükleri incelenecektir. Turkuaz Kart sahibi olan nitelikli yabancılara tanınan haklardan belki de en önemlisi, istisnai yolla Türk vatandaşlığına alınmaktadır. Bu bağlamda, Turkuaz Kart uygulaması ile istisnai yolla Türk vatandaşlığının kazanılması çalışmamızda değerlendirilecektir. Ayrıca, çalışmamızın son bölümünde diğer ülkelerde yatırımları teşvik etmek amacıyla getirilen ve Turkuaz Kart sistemine benzeyen, Avrupa Birliği Mavi Kart uygulaması gibi uygulamalarda kısaca açıklanacaktır.
In order to promote foreign investment, states are developing different practices. In particular, facilities are provided for the employment of qualied foreign employees. In recent years; Turkey has introduced essential reforms on work permits for foreigners. In particular with the International Work Force, Law No. 6735, a new work permit system has been introduced under the name Turquoise Card for qualified foreigners who will contribute positively to our country's economy and employment. In this article, the Turquoise Card, and how and by whom it can be taken, the rights and obligations of the Turquoise Card holder will be examined. The most important of the rights granted to qualified foreigners who are Turquoise Card holders is having a right to acquire Turkish citizenship in an exceptional way. In this context, this article will evaluate acquiring Turkish citizenship in exceptional ways with Turquoise card system. Furthermore, in the last part, this study will briefly explain other countries practices such as the European Union Blue Card system, which is similar to Turquoise Card system that is introduced to promote investment in these countries.
