dc.description.abstractİdare, COVID 19 salgını döneminde de sağlık hizmetleri alanında uygulamada ortaya çıkan yeni birtakım sorunlara yönelik hızlıca birtakım tedbirler alma ve başta Sağlık Uygulama Tebliği olmak üzere ek düzenlemeler veya değişiklikler yapma yoluna gitmiştir. Salgın hastalığın yarattığı yaşamsal tehdidin boyutu, anayasal ve sair mevzuat kapsamında sağlanan güvencelerin acil sağlık hizmetlerine erişim hakkı bakımından önemini ulusal ve uluslararası boyutta artırmıştır. Ulusal ve uluslararası mevzuat ile korunan sağlık hakkına erişimin temel ayaklarından biri yukarıda değinildiği üzere “Acil Sağlık Hizmetleri”dir. Anayasal güvenceler bağlamında acil sağlık hizmetlerine erişimin sağlık hakkı yanında, “sosyal güvenlik hakkı” ve “yaşam hakkı” gibi boyutları bulunmaktadır. COVID 19 Salgını döneminde acil sağlık hizmetlerine ücretsiz erişimde bazı sorunlar yaşanmıştır. Diğer yandan idarenin, salgın döneminde zuhur eden bu sorunlara karşı etkili ve ivedi çözümler üretme kabiliyeti olduğu da ortaya çıkmıştır. Bu minvalde, salgın hastalıklar kapsamında acil sağlık hizmetlerinden ücretsiz yararlanmaya dair güncel sorunlar ve gelişmeler tarafımızca idare hukuku cephesinden değerlendirilecektir.en_US
dc.description.abstractDuring the COVID 19 epidemic, the Administration took some measures quickly for some new problems that emerged in the field of health-care services and made additional regulations or changes, especially the Health Implementation Communique. The size of the vital threat posed by the epidemic has increased the importance of the guarantees provided under the constitutional and other legislation in terms of the right to access emergency health services, both nationally and internationally. As mentioned above, one of the main pillars of accessing the right to health, which is protected by national and international legislation, is the "Emergency Health Services" in case of emergency. In the context of constitutional guarantees, access to emergency health services has dimensions such as “right to social security” and “right to life”, as well as the right to health. During the COVID 19 Pandemic, there were some problems in free access to emergency health services. On the other hand, it has also been revealed that the administration has the ability to produce effective and urgent solutions against these problems that emerged during the epidemic period. In this respect, current problems and developments regarding free use of emergency health services within the scope of epidemics will be evaluated by us from the perspective of administrative law.en_US
