dc.description.abstractTaraar arasında sürekli borç ilişkisi doğuran iş sözleşmelerinde, borç ilişkisinin ani edimli olduğu sözleşme tiplerinden farklı olarak iş ilişkisinin konusunu teşkil eden edim zaman içerisinde belli bir süreyi kapsar. Sözleşmenin taraarı arasında karşılıklı edimlerin ifa edileceği bu süre ise belirli bir dönemle sınırlandırılabileceği gibi, böyle bir sınırlandırma olmaksızın edimin süresi belirsiz de olabilir. İş sözleşmelerinin belirttiğimiz niteliğine bağlı olarak belirli-belirsiz süreli iş sözleşmeleri ayrımına tabi tutulmasının temelinde her iki sözleşmeye bağlanan hukuki sonuçların farklı olması yatmaktadır. Bu çerçevede belirli-belirsiz süreli iş sözleşmelerine ilişkin 4857 sayılı İş Kanunu ve 6098 sayılı Türk Borçlar Kanunu bazı düzenlemelere yer vermiştir.Bu çalışmada, her iki Kanun bakımından belirli süreli iş sözleşmesinin tanımı, unsurları ve şekli üzerinde durulmuştur. Bunun yanında belirli ve belirsiz süreli iş sözleşmesi ayrımının önemine değinilmiş ve objektif nedenlerin varlığına bağlı olarak belirli süreli iş sözleşmesinin yapılması hususu ele alınmıştır. Belirli süreli iş sözleşmesinin zincirleme olarak yapılması hususu her iki Kanun bakımından irdelenmiştiren_US
dc.description.abstractIn employment contracts which create continuous obligation between the two parties, the obligation, which is the subject of labour relationship, covers certain time of period in contrast to the type of contracts with sudden performance. The period that parties perform reciprocal obligations can either be limited to a certain time or can be indenite without such limitations. Depending on the aforementioned character of employment contracts, the underlying basis of the classication of xed term-indenite period employment contracts is that the legal consequences of these two contracts are dierent. In this context, there are some regulations in 4857 numbered Labour Law and 6098 numbered Turkish Code of Obligations regarding xed term-indenite period employment contracts.In this study it is dealt with the denition, elements, and form of xed term employment contracts. Besides, the classication of xed term-indenite period employment contracts is examined and conclusion of xed term employment contracts depending on existence of objective reasoning is discussed. Conclusion of xed term employment contracts successively is also analysed in the light of these two Acts.en_US
