dc.description.abstractTürk Hukukunda kamu personelinin mali sorumluluğuna ve idarenin rücu yetkisine anayasa, yasa ve yönetmelik düzeyinde yer verilmiştir. Nispeten köklü bir müessese sayılan rücu mekanizması salt idare ve personel arasında beliren bir ilişki değildir. Hüküm ve sonuçları birlikte düşünüldüğünde rücu mekanizması idare, personel ve vatandaş arasında üç taraı bir etkiye sahiptir. Zira kamu görevlilerinin, geniş anlamda idarenin, hukuka aykırı işlem ve eylemlerinin denetiminde rücu mekanizması hem zarar vuku bulduktan sonra zararın tazmini hem de zarar vuku bulmadan önlenmesi işlevine birlikte sahiptir. Bu nedenle adı geçen kurum üzerinde hususiyetle durmak icap eder. Uygulamaya baktığımızda hukuki, idari ve siyasi bir takım sebeplerin rücu mekanizmasının işletilmesine engel teşkil ettiği görülmektedir. Bu çalışma sonucunda elde ettiğimiz bulgular ışığında rücu mekanizmasının işletilmesinin; hukuk devleti ve demokratik devlet ilkelerinin tesisi, adliyenin iş yükünün haemesi ve bireylerin hak arama özgürlüğünün sağlanması bakımından ne gibi bir işleve sahip olduğu ortaya konulacaktıren_US
dc.description.abstractIn Turkish Law, scal liability of the civil servant and rescission of the administration are regulated at a level of the constitution, code and directive. Relatively considered as a fundamental institution, the rescission procedure is not only a relation which appears between the administration and the civil servant. In consideration of both the conclusion and results, the rescission procedure has a three-way inuence on the administration, the civil servant and the citizen. Due to the fact that the rescission procedure for the control of a broad sense of the administration has functions which are compensation for damages occurring as a result of the civil servant’s unlawful actions and proceedings and prevention of damage before that occurred. For this reason, it would be particularly required a stand on the mentioned subject. In a look of the practice, it can be observed that a number of reasons such as legal, administrative and political issues are an obstacle to the operation of the rescission procedure. As a result of this study, our ndings would illuminate that execution of the rescission procedure has such a function in terms of subjects which are the provision of rule of law and democratic state principles, decrease the workload of the judiciary and ensuring the right to legal remedies.en_US
