Özet
Hukuk sistemimiz, hukuk eğitimimiz ve hukuk uygulamamız üzerine eleştiriler dile getiriliyor. “Yeteri kadar bizim olmamakla” suçlanıyor sistem, adalet ilkesine yeteri kadar dayanmamakla, fazla pozitivist olmakla; hâkimin etki altında kalmasından, hukukun bir türlü bağımsızlığını kazanamamasından yakınılıyor. Bu tarz eleştiriler hukuk felsefesi alanındaki en temel, en eski ve belki de sonuçsuz tartışmalardan biri olan doğal hukukçularla hukuki pozitivistler arasındaki tartışma ekseninde şekillenip başka hukuk okullarının doğmasına da olanak vermektedir. Kürsülerde hocalar, kendilerini yakın hissettikleri ideoloji ekseninde daha iyi ve daha adil hukukun nasıl olması gerektiğini dile getirirlerken, hukukun aslında tek gövdede üç başa sahip bir canlının başlarından biri olduğunu ve diğer iki başın ekonomi ve siyaset olduğunu unuturlar. Bu çalışmada odaklanılan konu, Türk Hukuk Sistemi’nin yakın olduğu, daha fazla özelliğine sahip olduğu bir hukuk okulunun olup olmadığı sorunudur. Uygulayıcının ve yasa koyucunun başlangıç noktasında hangi felsefi düşüncenin etkin olduğu sorusunun yanıtı aranmaktadır.
Criticisms have been voiced about our legal system, our legal education, and our legal practice. The system is accused of “not being ours enough”, not relying enough on the principle of justice, being too positivist; It is complained that the judge is under the influence and that the law cannot gain its independence. Such criticisms are shaped in the axis of the debate between natural lawyers and legal positivists, which is one of the most fundamental, oldest and perhaps inconclusive debates in the field of legal philosophy, and also allows the emergence of other schools of jurisprudence. While the professors are expressing how a better and fairer law should be based on the ideology they feel close to, they forget that the law is actually one of the heads of a living thing with three heads in one body, and that the other two heads are economy and politics. The focus of this study is the question of whether there are schools of jurisprudence that the Turkish Legal System is close to and includes more features of that schools. This work seeks an answer to the question that which philosophical thought is effective on the starting point of legal practitioners and lawmakers.
