dc.description.abstractOne of the most implicit foundations of a person's identity today, in a cultural, national as well as global context, is the collegial relationship which he or she shares with another person, that relationship ultimately giving formation to a conioint, consolidated and co-dependent recognition of the two as one under the law, particularly with respect to resolving socio-familial issues such as those of parentship, guardianship, adoption, succession and inheritance among others. The term 'relationship' mentioned above is connotative of marriage and the following paper attempts to look at this relationship, in its connection to the various facets of one's personal identity as a citizen, from the perspective of a third gender Hindu lndian national. Though the right to marry of such an individual, especially as seen against the backdrop of the existing communal ethos in the country may be accepted as being some form of a heterodoxy, it still falls short of qualifying as anything that could be called, in the least, 'heretical' or even illegal. Due to the constraints of time, the authors of the present study have been compelled to restrict the same to only a particular division of nationality and a sub-class thereof, in that it is only an examination of the scope of 'right to marry' under the Hindu personal law of lndia. The authors sincerely hope, however, that this study shall inspire further such examinations into its chosen subject within the field domains of other religions and nationaIities.en_US
dc.description.abstractGünümüzde kültürel. ulusal ve küresel bağlamda, kişinin kimliğinin en üstü kapalı temellerinden biri olan evlilik, bir başkasıyla paylaştığı en sonunda birleşik, dayanıklı ve birbirine bağlı hukuken iki kişiyi bir olarak tanıyan bir müşterek ilişkiye dönüşen; özellikle ebeveynlik, vesayet, evlat edinme, veraset ve miras gibi sosyo-ailevi problemlerin çözümünde eşit sorumluluklar yükleyen ilişkidir. Bu bildiride yukarıda bahsedilen evliliğin çağrışımları ve bu ilişki kavramı ile bu kavramın vatandaş olarak kişisel kimliğinin çeşitli yönleriyle 3. cinsiyet olan Hindu Hindistan vatandaşlarıyla ilişkisi incelenecektir. Böyle bir kişinin evlenme hakkı, özellikle ülkedeki var olan toplumsal inançlara aykırılığı, dine aykırı veya illegal olarak yetersiz değerlendirilmesi göz önüne alınınca bir çeşit sapma olarak kabul edilebilir. Zaman sınırlamaları nedeniyle bu bildirinin sunucuları çalışmayı vatandaşlığın belirli bir ayrımına ve ara sınıfa indirgemek durumundadırlar. Bu yüzden sadece Hindistan Hindu vatandaşlık hukukuna göre evlenme hakkı incelenmiştir. Sunucular bu çalışmaların diğer vatandaşlıkların ve dinlerin arasında bu konuya ilişkin gelecek incelemelere ilham vermesini umut etmektedirler.en_US
