Özet
Türk Medenî Kanununda boşanma, evliliği sona erdiren sebeplerden biri olarak kabul edilmiştir. Evliliği sona erdiren sebeplerden biri olduğu içindir ki hukukumuzda oldukça önemli bir yer tutmaktadır. Bununla birlikte boşanma sadece evlilik birliğini sona erdirmemekte aynı zamanda taraflar ve çocuklar için de beraberinde oldukça önemli sonuçları getirmektedir. Tezimizin konusu olan boşanmada maddi tazminat, boşanmanın mali sonuçları içerisinde yer alan önemli konulardan birini oluşturmaktadır. Çalışmamızda öncelikle boşanmayı ve boşanma sebeplerini kısaca inceledikten sonra esas konumuz olan boşanmada maddi tazminat kavramını, maddi tazminatın şartlarını, maddi tazminatın belirlenmesini, maddi tazminat belirlenirken göz önünde tutulması gereken hususları ve diğer ilgili usul hükümlerini doktrin ve yüksek mahkeme görüşleri ışığında inceleyerek açıklamaya çalıştık.
Divorce has admit as one of the reasons for ending marriage in the Turkish Civil Code. Because it is one of the reasons for ending marriage, it takes an important place in our law. However, divorce does not only end the marriage unity also it brings very important consequences for the parties and the children. Financial compensation in divorce which is the subject of our thesis, it takes constitute one of the important matters in the financial results of divorce. In our study, we primarily analyze the divorce and the reasons for the divorce in briefly, and then we try to explain the concept of material compensation in the divorce, the conditions of material compensation, the determination of the material compensation, the matters to be considered while determining the material compensation and other relating procedural adjudgments in terms of the doctrine and high court views.
