Acentelikte rekabet yasağı anlaşmasına ilişkin temel sorunlar

Acentenin rekabet yasağı anlaşması, acente ile müvekkil arasında acentelik sözleşmesinin sona ermesinden sonra, rekabetin engellenmesi amacıyla yapılan ve acentenin işletmesine ilişkin faaliyetlerini sınırlandıran bir anlaşmadır. Bu ilişkide, acentenin zayıf tarafta yer alması nedeniyle bazı korumalara ihtiyaç duyulmuştur. TK m.123'te yer alan düzenlemeler ile şekli ve maddi yönden bu korumalar sağlanmaya çalışılmıştır. Çalışma, acentenin rekabet yasağı anlaşmasının özellikleri, hükümleri ve rekabet yasağının sona ermesi kapsamında incelenmiştir

Agency prohibition of competition agreement is an agreement between the agency and the client, after the end of the agency contract, in order to block competition and limit their activities related to the operation of the agency. In this relationship, some protections are needed for the agencies because they seem to be on the weak side on the agreement. These protections are tried to be provided with the arrangements in TCC art. 123 in formal and corporeal aspects. This study is analyzed with the scope of the agreement of prohibition of competition of the agency, their provisions and expiry of prohibition of competition.
