Özet
Bu çalışmada, dış ticaretin bir parçası olan ithalat sürecinde depolama işlemlerinin yapıldığı antrepo alanları, bu alanların resmi olarak idaresini gerçekleştiren ve antrepo işleticisi ile devlete karşı müteselsil sorumlu olan Yetkilendirilmiş Gümrük Müşavirliği uygulaması incelenmiş ve irdelenmiştir. Bu çalışmanın amacı; antrepoların dış ticaret işlemleri üzerindeki etkilerinin hız ve maliyet ekseninde değerlendirilmesi, Yetkilendirilmiş Gümrük Müşavirliği olgusunun bu sürece dâhil edilmesi ile katkıları ve eksiklikleri çerçevesinde değerlendirilmesi amaçlanmıştır. Öncelikle; dış ticarette bakanlıkça verilen yetki çerçevesinde iş takibi yapan gümrük müşavirliği sistemi meri mevzuata göre tanıtılmış ve yetkilendirilmiş gümrük müşavirliği mesleğinin görev tanımı yapılarak gümrük müşavirliğinden farkları ve işlevi ortaya konulmuştur. Bu meslek kolunun ortaya çıkışı, antrepo süreçleri üzerindeki rolü ve işlevselliği konusunda değerlendirme ve önerilerde bulunulmuştur. Yetkilendirilmiş Gümrük Müşavirliği mesleğinin güvenli ve sistemli bir hale getirilmesi, bakanlıkça belirtildiği şekilde bağımsız ve tarafsız çalışması, antrepo ve antrepo rejiminin uygulandığı gümrük işlemlerinin doğru, güvenli ve hızlı gerçekleştirilmesi, daha etkin ve daha güçlü bir gümrük kamu hizmetinin tesis edilmesi, antrepolarda gerçekleşecek gümrük kaçakçılığının önüne geçilmesi ve tüm işlemlerinin resmi olarak sistemsel kayıt alınması gibi faydalar gözlenmekte ve beklenmektedir. Son zamanlarda mevzuatta yapılan bazı köklü değişiklikler ve bu konuda literatürde yer alması gereken yeni bir akademik çalışma ihtiyacı karşısında; bu yeni yapının veya mesleğin incelenmesi ve değerlendirilmesi gerekliliği bulunmaktadır.
In this study, warehouse areas where warehousing operations are carried out during the import process, which is a part of foreign trade, and the application of the Authorized Customs Brokerage, which officially manages these areas and is jointly responsible to the warehouse operator and the state, are examined and examined. The aim of this study; It is aimed to evaluate the effects of warehouses on foreign trade transactions on the axis of speed and cost, to include the phenomenon of Authorized Customs Consultancy in this process and to evaluate it within the framework of its contributions and deficiencies. Firstly; The customs consultancy system, which carries out business follow-up within the framework of the authority given by the Ministry in foreign trade, has been introduced according to the current legislation and the job definition of the authorized customs consultancy profession has been made, and its differences and functions from the customs consultancy have been revealed. Evaluations and suggestions were made about the emergence of this profession, its role on the warehouse processes and its functionality. Making the authorized customs brokerage profession safe and systematic, working independently and impartially as specified by the ministry, carrying out the customs transactions in which the warehouse and warehouse regime is applied correctly, safely and quickly, establishing a more effective and stronger customs public service, preventing customs smuggling in warehouses. Benefits are observed and expected, such as passing the In the face of some radical changes made in the legislation recently and the need for a new academic study that should be included in the literature on this subject; There is a need to examine and evaluate this new structure or profession.
