Abstract
0f the ten Article XX exceptions in the General Agreement on Tariffs and Trade (GATT) 1994, Article XX (a) has received relatively little scrutiny. Jurisprudence interpreting the term "public morals" in Article XX (a) has been limited, with only the decision in China - Publications thoroughly examining the provision. Accordingly, much uncertainty shrouds the application of Article XX (a) and the scope of the term "public morals" remains amorphous.
GATT 1994 madde XX (a) bendi kapsamındaki on istisna, nispeten daha az incelemeye konu olmuştur. Hukuk bilimi madde XX (a) bendindeki "kamu ahlakı" kavramını sadece China-Publications kararındaki hükümleri bütünüyle yorumlayarak sınırlı tutmuştur. Bundan dolayı, belirsizIikler madde XX (a)'nın uygulanmasına gölge düşürmekte ve "kamu ahlakı" kavramının kapsamı biçimsiz kalmaktadır.
