Abstract
Hekimin hastaya karşı sorumluluklarının başında sır saklama yükümlülüğü gelir. Türk Ceza Kanunu (TCK) 280. Madde uygulamada sorunlara yol açtığı için eleştirilmekteydi. Uyuşturucu madde kullanan ve tedavi olmak isteyen hastalar konusunda oluşan sorunların önüne geçmek için TCK 192. Maddede yapılan düzenlemeyi öne çıkarıp hekimlerce farkındalığının arttırılmasını amaçladık. TCK 192 maddede yapılan değişiklik ile hasta hekim arasında güven ilişkisi korunmuştur. Bu maddede yapılan değişiklik ile hekimlerin TCK 280. Maddeden dolayı yargılanmalarına engel olunmuştur. Hasta ve hekim arasındaki etik ilişkiyi koruyan bu düzenlemenin hekimler tarafından bilinmesi ve bu yasa maddesine göre davranılması hasta tedavisini de pozitif yönde etkileyecektir.
The primary responsibility of the physician towards the patient is the obligation to keep confidentiality. The Turkish Penal Code (TPK) was criticized in Article 280 for causing problems in practice. We aimed to raise the awareness of physicians by highlighting the regulation made in Article 192 of the Turkish Penal Code in order to prevent the problems that occur in patients who use drugs and want to be treated. With the amendment made in 192 articles of the TPC, the relationship of trust between the patient and the physician was preserved. With the amendment made in this article, physicians were prevented from being prosecuted due to Article 280 of the Turkish Penal Code. Knowing this regulation, which protects the ethical relationship between the patient and the physician, and acting in accordance with this law will also positively affect the patient's treatment.
