dc.description.abstract“İş Sözleşmesi Türleri ve İkale Sözleşmesi” başlıklı bu tez çalışması, Türk İş Hukuku kapsamında yer alan iş sözleşmelerinin incelenmesini, buna bağlı olarak da bu iş sözleşmelerinin sona erme biçimlerini ve bunların yanı sıra ikale sözleşmesi ile iş sözleşmelerinin sona erdirilmesini içermektedir. Bu tezin amacı, iş sözleşmelerinin ikale sözleşmesi ile sona erdirilmesinin sonuçlarını ortaya koymaktır. Bunun için de öğretideki görüşlerle birlikte ilgili Yargıtay kararlarının tartışılması yoluna gidilmiştir. Diğer özel hukuk sözleşmeleri gibi iş sözleşmesinin de ikale yoluyla sona erdirilmesi mümkündür. İş hukukunun özellikle işçiyi korumaya yönelik kurallar içermesi nedeniyle; iş sözleşmesinin ikale sözleşmesi ile sona erdirildiği hallerde meydana gelebilecek sonuçlar, kazanımlar ve kayıplar, üzerinde dikkatle durulması gereken konulardır. Birinci bölümde iş sözleşmesinin tanımı, şekli ve iş sözleşmesinin türünü ve çalışma biçimlerini belirleme serbestisi üzerinde durulduktan sonra tek tek iş sözleşmesi türleri incelenmiştir. İkale sözleşmesinin iş sözleşmelerinde uygulanması halinde, özellikle iş güvencesi kurallarının ortadan kaldırılması ve işçinin haklarından yoksun bırakılması durumu söz konusu olduğundan; ikinci bölümde, iş sözleşmesinin diğer sona erme halleri incelenmiş ve fesih kurumu üzerinde özellikle durulmuştur. Üçüncü bölümde ise ikale sözleşmesinin Türk hukuk sistemindeki yeri ele alındıktan sonra, sırasıyla borçlar hukuku ve iş hukuku yönünden incelemesi yapılmış, benzer amaca yönelik diğer hukuki kavramlarla ikale kavramı karşılaştırılmıştır. en_US
dc.description.abstract"Types of Labour Contract and Termination by Mutual Agreement" title of this thesis, the Turkish Labour Law are included in labour contracts reviewed, depending on this or that labour contracts ended their ways and their addition to termination by mutual agreement with the labour contracts terminating contains. Termination by mutual agreement labour contracts case of application, in particular, job security rules, elimination, and worker's rights, deprives the case in question is the second chapter of labour contract other termination cases examined and termination authority over the particular mentioned. In the third part of the termination by mutual agreement the Turkish legal system in after considering, respectively, debt law and business law in terms of examination was performed, and a similar purpose, other legal concepts and termination by mutual agreement the concept are compared.en_US
