Özet
Teknolojik gelişmelerin hızla ilerlemesi, rekabet ortamının artması, iş hayatının uzmanlık dallarına ayrılması, sürekli şekillenen ve gittikçe küreselleşmeye ihtiyaç duyulan yaşadığımız çağda alt işveren kavramının doğması kaçınılmaz olmuştur. İşveren ve işçi arasında belirli veya belirsiz süreli olarak imzalanan tipik iş akitlerinin yerini, asıl iş sahibine ait olan işin belli bir kısmının veya işin teknik bilgi/uzmanlık gerektiren kısımlarının veyahut kısa süreli devam edecek işlerin gördürülmesi olan alt işverenlik kurumu almış; böylece ticari hayatta yeni bir boyuta geçilerek alt işveren kavramı ile tanışılmıştır. Alt işverenden yararlanılması yalnızca özel sektörde görülmemekte; istihdam açısından önemli bir konuma sahip olan kamu sektöründe de etkin bir şekilde yer almaktadır. Devlet politikalarının değişmesi ve sosyal devlet anlayışının gelişmesi ile kamu sektörüne ait işlerin alt işverenler aracılığıyla yürütülmesi benimsenmiştir. Bu çerçevede çalışmamızda öncelikle alt işverenlik kavramı İş Hukuku düzenlenmeleri çerçevesinde ele alınmış ve alt işverenlik uygulamasının kamu sektöründeki yeri ve seyri incelenmiştir.
The emergence of the concept of subcontractor has become inevitable in this era which technological developments are advancing rapidly, competitive environment is increasing, business life is divided into specialties, constantly shaped and increasingly globalization is needed. Typical work contracts signed between the employer and the employee for a fixed or indefinite period have been replaced by the subcontracting agencies which take over the task of displaying a certain part of the work that belongs to the main business owner or parts of the work requiring technical knowledge/expertise or short-term works; thus, a new dimension has been introduced in commercial life and the concept of subcontractor has been introduced. The use of subcontracting is not only seen in the private sector; It is also actively involved in the public sector, which has an important position in terms of employment. With the change of the government policies and the development of the social state understanding, it has been adopted to carry out the works of the public sector through subcontractors. Within this framework, in this study, firstly, the concept of subcontracting was discussed within the framework of Labor Law regulations and the place and practices of subcontracting in public sector were examined.
