dc.description.abstractYapı alacaklısı ipoteği, yapı faaliyetinden doğan alacak hakkının güvence altına alınması amacını taşır. Kanuni ipotekler arasında yer alan yapı alacaklısı ipoteği tescil ile kurulur. Yapı alacaklısı bakımından tescil isteminde bulunulabilmesi için ipotek bedelinin malik tarafından kabul edilmesi ya da mahkeme kararıyla tespit edilmesi gerekir. Bunun yanında yapı alacağının karşılanması için yeterli güvence gösterilmişse tescil istemi ileri sürülemez. Yapı alacaklısı, kendi edimini yerine getirmeyi yüklendiği andan itibaren tescil isteminde bulunabileceği gibi yüklenilen işin tamamlanmasından itibaren kanunda öngörülen hak düşürücü süre içinde de tescilin yapılmasını sağlayabilir.en_US
dc.description.abstractThe aim of the mechanic’s lien is to ensure the claims of tradesmen and building contractors who have supplied labour and materials or labour alone, for construction or other works. Mechanic’s lien will be recorded in the land register as the date of undertaking to perform work. Application for the entry must be made within the prescription period that starts with completion of the work. The registration is possible only if the claim has been acknowledged by the owner or conrmed in a judgment. Furthermore, registration can’t be requested if the owner provides an adequate security.en_US
