Özet
Siyasal ve ekonomik faktörler, devletlerarası çıkar ilişkileri, çatışmaları, sınırlar, milliyetçilik hareketleri, açlık, sefalet, yoksulluk, salgın hastalıklar, doğa olayları, insan hakları ihlalleri gibi nedenler, küresel düzeyde ve kapsamı artarak devam eden zorla yerinden edilmeler göç ve mülteci meselesini dünyanın hemen her devletini ilgilendiren bir sorun haline getirmiştir. Uluslararası ilişkilerde devletlerin iç ve dış politikaları güvenlik eksenli olarak geliştirilmektedir. Uluslararası hukukta sığınmacı ve mülteci haklarının dikkate alınarak göç ve mülteci politikalarının oluşturulduğu varsayımına rağmen, bu alandaki politika ve uygulamalar güvenlik odaklı olarak devam etmektedir. Bu politikaların sonucunda göçler önlenemediği gibi, bu alanda insan kaçakçılığı artmakta ve daha birçok suç ağlarının oluşmasına da yol açmaktadır. Tezin ilk bölümünde göç tanımları ve göç kuramları ele alınmaktadır. İkinci bölümünde sığınmacı, mülteci kavramları, mülteci hukukunun gelişimi ele alınmaktadır. Üçüncü bölümde, Türkiye göç, sığınmacı, mülteci politikaları ve bu politikaları etkileyen faktörler ele alınarak dünyada mültecilerin durumu insan hakları perspektifinden değerlendirilmektedir.
Political and economic factors such as interstate relations and conflicts of interest, borders, nationalist movements as well as hunger, misery, poverty, epidemics, natural events, human rights violations and forced migrations taking place around the globe make migration and refugee issues problems that concern almost every country in the world. In international relations, both domestic and foreign policies of countries are developed on the basis of security. Despite the assumption that migration and refugee policies are established in international law taking into consideration asylum seekers’ and refugees’ rights, security still is the focus of the policies and practices in these areas. As a consequence, not only migration becomes unpreventable, but this situation also results in the rise in human trafficking and gives rise to the formation of new criminal networks. In the first section of the thesis, various definitions of migration as well as some theories on migration are discussed. The second section takes up and elucidates the concepts of asylum seeker and refugee. Furthermore, this section includes the discussion of the development of refugee laws. Finally, in the third section, tackling Turkey's policies on migration, asylum seekers refugees as well as the factors at work in these policies, the case of the refugees in the global context is evaluated from the perspective of human rights.
