Özet
Evlilik birliğinin boşanma ile sonuçlanması halinde tarafların birbirlerinden talepleri olacaktır. Bu çalışmanın konusu da tarafların birbirlerinden talep etmiş oldukları maddi ve manevi tazminat, tazminatın koşulları, bu tazminatın hangi hallerde istenebileceği, maddi ve manevi tazminatının belirlenmesinde dikkat edilecek hususlar, 4721 sayılı Türk Medenî Kanunun getirdiği yenilikler, bu davalarda uygulanacak usul kuralları ve Yargıtay uygulamasının neler olduğudur. Bu çalışma; giriş, dört bölüm ve sonuç kısmından oluşmaktadır. Giriş bölümünde; bu çalışmanın amacı, birinci bölümde; boşanmaya genel bakış, ikinci bölümde; boşanma davası hakkında genel bilgiler, üçüncü bölümde; boşanma halinde maddi tazminat, dördüncü bölümde; boşanma halinde manevi tazminat ve sonuç bölümünde ise; Yeni Medenî Kanunda maddi ve manevi tazminat ile ilgili değişiklikler incelenmiştir.

Subject of this thesis is demands of divorced parties such as economical and moral indemnity, indemnity conditions, asked in what manners, points to consider when asking for indemnity, innovations of article 4721 Civil Code, rules of procedure applied for such cases and Court of Appeal enforcement. Subject thesis includes introduction, four chapters and conclusion. Introduction section; purpose of this study. First section; divorce overview. Second section; general information about divorce . Third section; damages for mental anguish in case of divorce. Fourth section; trial procedure and the result section is; The new Civil Law pecuniary damages and related changes.
