Özet
Kıbrıs Türk Cumhuriyeti Anayasa Mahkemesi 2017 yılında verdiği bir kararda toplu iş sözleşmesi özerkliğinin öz güvencesi ve yasa yolu ile toplu iş sözleşmesi ile tavan getirilmesi konularında önemli saptamalarda bulunmaktadır. Karar bu yönü ile yasal düzenlemeler konusunda büyük ölçüde benzerlik arz eden Türk Hukuku bakımından da önemli ilkeleri ortaya koymaktadır. Kıbrıs Türk Cumhuriyeti Anayasa Mahkemesi’nin kararı çerçevesinde bir karar incelemesi, her iki hukuk açısından karşılaştırma yapmak konunun aydınlanması bakımından yararlı olacaktır.
The Constitutional Court of the Turkish Cypriot Constitution in 2017 has made important decisions in the matter of self-assurance of the autonomy of the collective labor agreement and the ceiling of collective labor agreement by law. In this respect, the Decision also sets out important principles in terms of Turkish Law, which has a great similarity in terms of legal regulations. An examination of the jurisdiction with making comparisons in terms of both laws within the framework of the decision of the Constitutional Court of the Turkish Cypriot Republic will be beneficial for enlightenment.
