| dc.description.abstract | The current debate on immigration olten attempts to balance the state's right to sovereignty and the individual's right to free movement across different states. The tension between these two is evident in international law, where the right to emigrate ıs recognized but the right to immigrate is not. This discrepancy has immense practical consequences. Those who emigrate but are unable to immigrate are rendered stateless, a dangerous phenomenon where individuals not only loose their national identity but their "right to have rights"'as Hannah Arendt famously termed. This paper argues that the tension between state sovereignty and human rights is inherent in liberal political thought because of a social contract theory that links a government's legitimacy to its prioritization of individuals who have formed a "contract" with the government through consent,.. | en_US |
| dc.description.abstract | Göç hakkındaki güncel tartışmalar genellikle devletlerin egemenlik hakkı ile bireylerin devletler arası özgür dolaşım hakkı arasında denge kurmaya çalışmaktadırlar. Bir yerden göç etme hakkını tanıyan fakat bir yere göç etme hakkını tanımayan uluslararası hukukta ise bu ikisi arasındaki gerilim açıktır. Bu fark uygulamada çok büyük sonuçlara yol açmaktadır, Bir ülkeyi terk eden fakat başka bir ülkeye göçmen olarak giremeyenler devletsiz bırakılmaktadır. Bu da bireylerin yalnızca milli kimliklerini değil, Hannah Arendt'in meşhur ifadesinde işaret ettiği gibi "hak sahibi olma haklarını" da kaybetmelerine yol açmaktadır.
