dc.description.abstractArtificial Intelligence (AI) is the simulation of human intelligence processes by machines. Because of rapid and subsequent development, it has shown over the passage of last decade, it has replaced human intelligence in various areas. The replacement of human intelligence with machines has on the one hand significantly changed the nature of work and its consequences and on the other hand it has created problems that need to be addressed. Since, before the introduction of AI in daily life there was only human conduct which affected the other human beings, it was easy to determine the liability which accrued as a result of human conduct, attracting legal implications in the form of offence, tort or breach of a contract. Now AI affects human beings in different forms that include the defamation and breach of privacy or security. On the conduct of AI, the determination of liability is a problem because AI is beyond the ambit of punishment and it cannot be held liable to pay the damages. This paper aims to create awareness on the need of development of a legal regime to deal with issues relate to AI. Moreover, the paper is an attempt to put hands on the various aspects of the implications of AI because this area continues to evolve. The paper is an attempt to articulate the legal problems created by the advancement in AI so that a direction for the legal deliberation could be devised.en_US
dc.description.abstractYapay Zeka (YZ), insan zekasının makinalar tarafından yürütülen simülasyonudur. Son zamanlardaki hızlı gelişim nedeniyle, son 10 yıl zarfında, yapay zeka çok çeşitli alanlarda insan zekasının yerini almıştır. İnsan zekasının makinelerle değiştirilmesi, bir yandan işin doğasını ve sonuçlarını önemli ölçüde değiştirmiş, diğer yandan ele alınması gereken problemler yaratmıştır. Zira, gündelik hayatta YZ kullanılmadan önce, diğer insanları etkileyen sadece insan davranışı vardı. Suç, haksız fiil, sözleşme ihlali gibi hukuki sonuçlar doğuran insan davranışı sonucunda sorumluluğu belirlemek kolaydı. Şimdi YZ, insanları, hakaret ve mahremiyet veya güvenlik ihlalini içeren farklı biçimlerde etkiliyor. YZ’nin eylemi sonucunda sorumluluğun belirlenmesi bir sorun teşkil etmektedir çünkü YZ, ceza sınırının ötesindedir ve tazminatların ödenmesinden sorumlu tutulamaz. Bu makale, YZ ile ilgili konuları kapsayacak hukuksal düzenlemelerin geliştirilmesi adına farkındalık yaratma yönünde katkı sağlamayı amaçlamaktadır. Dahası, bu makale YZ’nin etkilerinin çeşitli yönlerine değinme çabasıdır çünkü bu alan gelişmeye devam etmektedir. Bu makale YZ’deki ilerlemenin yarattığı yasal sorunları dile getirme girişimidir, böylece hukuki tartışma için bir yön belirlenebilir.en_US
