Özet
Rekabet, teşebbüslerin mal ve hizmet piyasasında birbirlerine karşı üstünlük sağlama yarışıdır. Rekabetin sağlıklı bir şekilde işlemesi için rakiplerin dürüstlük kuralına uygun olarak rekabet etmeleri gerekmektedir. Aksi halde haksız rekabet halleri meydana gelecektir. Teknolojik gelişmelerle birlikte sosyal ve ticari yaşamın hemen hemen tamamı dijital dönüşüm sürecindedir. Yaşanan dijital dönüşüm süreci rekabeti de etkilemektedir. Bu nedenle teşebbüsler mal ve hizmetlerini dijital mecralarda daha fazla pazarlamaya başlamışlardır. Rekabet piyasasındaki bu dönüşüm, klasik haksız rekabet hallerinin dışında, yeni ve daha önce karşılaşılmamış haksız rekabet hallerinin ortaya çıkmasına neden olmuştur. Çalışmamızda; geleneksel mecralardan dijital mecralara geçiş süreci, geleneksel haksız rekabet hukukunun dijital dönüşüm karşısında uygulanılabilirliği, dijital mecralarda karşılaşılan haksız rekabet halleri ve bu haksız rekabet ihlalleri karşısında başvurulabilinecek kanun yolları yargı kararları ışığında irdelenmiştir.
Competition is the race of undertakings to gain superiority against each other in the goods and services market. In order for competition to function in a healthy way, the competitors must engage in competitive activities in accordance with the honesty rule. Otherwise, unfair competition will occur. With technological developments, almost all of social and commercial life is in the process of digital transformation. The digital transformation process also affects competition. For this reason, undertakings have begun to market their goods and services more in digital environment. This transformation in the competition market has led to the emergence of new and unprecedented cases of unfair competition, apart from the classical cases of unfair competition. In our study, the transition process from traditional environments to digital environments, the applicability of traditional unfair competition law to digital transformation, the cases of unfair competition encountered in digital environments and the legal remedies that can be applied against these unfair competition violations are examined in the light of judicial decisions.
